That alone should have been a slam dunk, but it further showed his intoxicated state of mind, his actions of swallowing some substance shortly before his arrest, and his repeated failure to comply, which included unintentionally causing harm to two officers by kicking them in a panicked drug induced state. As for criminal negligence, that was undone by the toxicology report saying that George Floyd was likely dead even if he was immediately rushed to emergency care, and his death was due entirely to him swallowing lethal dose of a notoriously toxic substance all at once, while in an emotional state of accelerated heartbeat, while being grossly out of shape to high degrees of unhealthiness and with previous damage caused by medical emergency situations due to similar factors.
