This has some serious problems. Committing a crime that does not directly result in death should not be treated as murder. If A sells bad dope to B who sells it to C who dies from it, should A be charged with murder? If A sells a gun illegally to B who shoots and kills C should A be charged with murder? I didn't get a clear idea of how this would be applied but there is potential for this legal theory to be abused by the government.
