So if someone creates a 501c and publicly states all proceeds to be used for x, does that mean those that created the non profit can actually take out expenses and otherwise pay themselves ?? ...

My understanding is you can pay salaries related to getting the job done but you can't do member draws like in an LLC. If Kolfarge had been considered an employee and drawn paychecks (with taxes withheld), he would have been fine.

Yea, i wonder if that is what the tax charges relate too - drawing expense money but neglecting to pay the tax (for what ever reason) on those payments.

No. He got sentenced on taking funds FROM the Wall Fund and using them on his own personal expenses.

“Kolfage, a US Air Force veteran who lost his legs and right hand in a rocket attack in Iraq, pleaded guilty last year to misappropriating more than $350,000 from the “We Build the Wall” campaign. The 41-year-old was sentenced to 51 months in prison at a hearing in federal court in Manhattan on Wednesday. Prosecutors said that he spent the money on cosmetic surgery, boat payments and jewellery. In addition, he also pleaded guilty to tax charges.”

If he had claimed a salary instead (and taxes withheld), there would have been no issue.
