That's a big problem with the current US legal system; it doesn't matter if "everyone's doing it", the government can single you out and it's not a valid defense that you're not alone. For that matter, I've seen statistics that the average person breaks three laws a day without even knowing it; all it takes is a bit of research to charge you.

Best thing you can do is find some people high in the hierarchy who are doing it and file criminal complaints against them. If those are ignored while they continue to prosecute you then you have a better chance.
