Once the SCROTUM rules it legal it's also a tacit admission the constitution is null and void. Kike Roberts obamacare is a tax was a more low key admission nobody apparently understood.

Schrodingers ruling. Once their desired ruling is realized, the country which enforces it is null and void. Thus at this moment it is both something that can exist at not at the same time.
