He’s immune. I don’t think they can even force him to testify at a hearing.

As I currently understand it, there is a to Biden's end of term Pardons and Grantings of Clemency, due to his and/or other people's use of the Autopen to sign bills.

He clearly was not of sound mind towards the end of his presidency, and probably was not of sound mind, even during the beginning of his presidency, which calls into question, who was operating the Autopen, and does any member of the Chief Executive's Cabinet have authorization to use the Autopen at their will to grant pardons? Do his staffers have the right to use the Autopen in addition to his Cabinet Chiefs?

Are we electing an Administration rather than an individual President?

I suspect once this lawsuit reaches the SCOTUS, the use of the Autopen will be struck down, but what the fuck do I know.

There are also issues with whether pre-emptive pardons are valid at all. The pardon power was designed for the President to be able to issue a pardon to someone who was validly convicted through the judicial process, but that the specific details of the case did not warrant the punishment the law imposed. A pre-emptive pardon makes a mockery of that. There is no conviction that is being pardoned, no sentence commuted, Biden's pre-emptive pardons don't even specify the supposed crime that was committed, it's just a blanket pardon. This power has not been tested legally.... yet.

They will say Biden gave them authorization But they knew he was not of sound mind.

The button pusher was some low level and probably didn't even know it was a pardon.

I read about that, but I think they would have to prove that Biden was unaware that any particular order was signed without his knowledge and there is no way to prove that.

I don’t think it matters that he was mentally unfit. He was ruled unfit to stand trial during the whole Burisma case and yet he continued acting as US president as though that never happened.

I wish them luck with the legal challenge, but I doubt any Biden executive orders will be struck down because that would have real consequences.

He got a pardon going back to 2014, For ALL crimes he may have committed.
