I don’t think it matters that he was mentally unfit. He was ruled unfit to stand trial during the whole Burisma case and yet he continued acting as US president as though that never happened.
I wish them luck with the legal challenge, but I doubt any Biden executive orders will be struck down because that would have real consequences.
