It's easy to argue that it's breach of civil contract. Or even criminal fraud (promising a spouse fidelity to trick them into providing resources they otherwise wouldn't). I could even see an edge case for reckless endangerment if someone's contracting STDs from infidelity.
Where are you getting the rationale for a capital crime from?
