That thing will probably sue and win a wrongful termination law suit. Imagine hiring this guy and then he starts to show up with five o’clock shadow wearing a dress makeup and wig working the counter of your business interacting with customers. Best not to put this stuff in writing and just come up with a plausible cause for termination. Sadly employers have very little recourse to deal with this
