Okay? Had he stopped. At all. To notify the car that he's on his way across rather than being stopped (for the darker car) and then just dashing out in front of the second vehicle. Not motor vehicle violation happened. So I'm not sure why you b ring that up. The predditor was wrong and should have been hit and the driver would have been legally in the clear.

where im from a pedestrian on a pedestrian crossing ALWAYS has right of way. He could have been walking on his hands with his head up his arsehole and the driver would still have been charged with culpable driving.

Yeah I know the law. The driver is fine. This pedestrian could and should be charged though. Had he STOPPED and made himself known, which doesn't mean waving his arms around etc. But stopped to show he wanted to cross rather than just walk foward through the walk. This is what's called looking both way b efore you cross.

This makes sense. Pedestrians also need to be known before they can expect to halt traffic. Traffic matters and is a thing that needs to be flowing. Rather than stop and go nonsense that causes significant issues. If a car were to stop completely for EVER person even near a crosswalk then traffic flow would be backed up for miles.
