Interesting spin. Here's a hypothetical: two forces are facing one another. One in a city, one trying to take it, both with civilians in the middle. Who is the war criminal, the side that refuses to let civilians Evacuate the city, or the side that ignores the human shields and blasts the city anyway? That's a little tidbit the NYT failed to mention.
