He was charged with reckless homicide. I wonder what is the reason for the holdout to stand their ground?

I dunno, Lauder.

From wiki:

>Reckless homicide is a crime in which the perpetrator was aware that their act creates significant risk of death or grievous bodily harm in the victim, but ignores the risk and continues to act, and a human death results.

Maybe we're missing information, but it seems cut-and-dry.

Weird stuff happens in courtrooms. A dear friend of mine was murdered, and a witness told the whole story in court. A punk had stolen my friend's guns, my friend found out and told the kid he wouldn't call the law if the kid returned the guns and mowed his yard all summer.

So for that act of kindness, the kid snuck into my friend's house (along with the witness, who was unaware he was to be involved in murder), and stabbed my friend through the heart as he was asleep in bed.

But some old fucker got on the stand for the defense, and started rambling about the kid and how his grandfather was well-known in the community, and he started doing with his hands. And when he stepped down, he nodded at one of the jurors, who flashed him a quick thumbs up. It ended in mistrial. Picked up the next year, the kid was sentenced to 5 years...but with time served and good behavior, he served about two years.

Looks like a jenky intersection; can't really prove intent strongly.

He was going over 20mph above the limit. That's already considered .

>In Illinois, a person can be convicted of "reckless driving" for: driving a vehicle with "a willful or wanton disregard for the safety of persons or property," or knowingly using an incline in a roadway to jump a vehicle. The statute uses the term "willful" to refer to conduct that's intentional or purposeful. And "wanton disregard" basically means the person understood the conduct was risky but chose to do it anyway.

And he killed five people while doing it.

>A reckless driving offense that results in the death of another person will likely lead to reckless homicide charges.

Seems like reckless homicide to me. No intent needed.

One juror said not guilty of "reckless homicide".

Three boys, ages 6, 4, and 19 months. The mother was 29. They were on their way to church.

On the surface it stinks like freemasonry. They tend to take care of their own.

Doesn't seem like it was overcharged.
