I think that the gonads are actually the key to determining sex.
There is a rare disease (Swyer Syndrome) where people with XY (should be male) end up pretty much like a female, but they don't go through puberty and don't make eggs. They can menstruate if given hormones, and even carry a baby in their uterus if one is implanted.
