I agree, they're unconstitutional - but void would imply they're toothless, and a law enforced that ends you in jail or fined (etc) after all judicial proceedings, is not void... it has been cast upon you with full effect.

On the other hand, if a law was not enforced, then it is void by reason of voluntary restraint by the state.

My point was at any point the government can say 'fuck it', blow some shit up, start a major war and force me into the service. If I am adult enough to be canon fodder, I am old enough to decide if I want cigarettes. Active military is irrelevant.
