ALL government employees are frozen into a state of inaction while the legal department makes the decisions. Any further government action must be approved by legal prior to the commencement of action. This only works when you have a good lawyer representing you. If you do not, then they will walk all over you. However, if you do, then they will exhibit absolute caution so as not to incur further liability.

As a general practice, the lawyers will meet to discuss aspects of the case. If the government has severely overstepped their bounds, which is almost always the case, then the government lawyers will more often than not look to settle to make it go away quietly. That is their job.
