To be fair the "below prosecutor's request" thing people are harping about kind of pisses me off. It's not a judges job to give a prosecutor whatever they want. That would be an insane system. Maybe I'm bad because I tend to think more about the meta issues, but people's failure to do that is how we dig our selves into a worse and worse system. Everyone has their issue they care about. It's all they want to think about. Throw every principle to the fire to pursue that one issue, and pretty soon we've got retarded shit like civil asset forfeiture (I was concerned about drugs), and everyone paying income tax (I was concerned about WWI and beating those pesky Germans). Complain about the right things. That a judge didn't hand prosecutors anything they ask for is not something to get in the habit of complaining about, unless you're retarded. That's just not a metric anyone with a brain should be pushing.
