Not convinced. visibility is poor and the retarded tow truck driver has his ramp down, no lights, no flairs, not even flahsers, he is on the wrong side of the road next to all the flashing lights.

In other words there are no indicators the vehicle in front is stopped and there's an assload of distractions on the other side, the tow truck driver should know better and so should the cops.

This person will sue and likely win.

I'm curious explaining in court on a clear fine day and straight dual roadway, How did she not see the truck from hundreds of feet away when approaching, and still failed to realize it was stationary and then also neglected to change lanes to avoid it ??. Even with several vehicles, fire tender and police cars with activated lights parked right there on the grass This is just pure negligence and inattention on her part.

The onus will be on the tow truck driver and the cops to explain why there is a tow truck in the wrong lane with it's ramp down and no lights or safety markings.

You're the only person that thinks a stopped car on a freeway with no lights isn't a hazard. The world does not conform to your thinking.

No, first off i agree the truck shouldnt be there, i'm wondering how she didnt see it, since it was stationary and it were a long clear stretch of road. if a vehicle broke down and is still in the lane she drives along 10 minutes later and she's not cognizant enough to avoid it, it's not also her fault ?? Nothing talmudic logic inversion at all - driving requires full concentration and awareness - not gawking at the flashing lights of a bunch of vehicles in the median. It s literally why anyone following too close that runs up the ass end of a vehicle when it stops suddenly is generally considered at fault. Not sure what road code you have but mine makes it clear you need to leave enough room between you and the vehicle in front to be able to stop without hitting it .

eh I'm not sure. I agree with GumbyTM. Everyone focuses on how it was a woman. I doubt she was on her phone/texting because she moves out of the way of the vehicle that's slowing down hard. She might assume that driver is rubber necking at the wreck, in the other lane. It's not clear from that angle she could see the tow truck (or if she did, it wasn't clear IT WAS PARKED IN THE FUCKING FAST LANE).

Tow truck driver is a dumbshit. He should have been in the median, or on the side with the cops, or asked a cop to get behind him with lights on.

I once saw a car slow down hard in front of me, almost coming to a stop, and was like "What the hell is he doing." When he switched lanes, I dropped into second and accelerated, then immediately had to break and felt my ABS kick in as there was a fucking bookcase on the highway in front of me! I had to wait for other cars to get around it and saw others do the same thing in my read view.

Maybe she could have prevented this by being more alert/aware, but ultimately the tow truck driver seems at fault here.

I dont disagree with you about the truck parked in the lane, but from all the video footage of the accident the road is hundreds of feet long and straight. It's gross inattention on her part.
