1) he could have braked before any contact avoiding an accident. Best case he was a distracted driver, but it's pretty clear he was just being a stubborn ass.
2) when the truck made contact, the truck in front was to blame, but again, the eating truck driver could have BRAKED. Instead he road raged and swerved right, creating a perfect PIT maneuver and wrecking the other truck.
Both are to blame. We don't need assholes like this in our society. We need a polite society that respects other people. Both should be severely punished.
