The 1st is designed to protect you against the government. For everyone else there is tort libel and slander. And one party must show financial injury. AFAIK, no such injury has been shown. On this basis alone, a judge who isn't corrupt would have tossed the case out with a slap again their lawyer and the parents in question. But that requires a judge not be corrupt and actually care to uphold the law. Will add, I've not paid much attention to the case. So is possible there is meat to the complaint I've not heard about. But what I have seen is simply people crying and saying "shut up and give me money."
