The same way they can incarcerate you before conviction. There's a clear and present danger if you associate with them, or there's a chance you'll reoffend or collaborate with a person charged in the same crime with you.

LoL Wasn't that one of the founding principles of this nation, that people should not be incarcerated before conviction?

No. No, they've been doing that since day one. In fact, they used to hold more people in jail prior to conviction than they do now. Bail and bond are fairly new in our history. They'd even hold you in matters of debt and other petty offenses.

I thought bail was one of the main grievances of the colonists
