Not really. They bitched about a lot of stuff, including the justice system, but we've been detaining people before conviction since day one.
Justice used to be faster, however. They'd find you guilty in a day and hang you the following morning. In the cities it was more organized. In the rural areas, they'd hold you in jail until a traveling judge came to their county/town. They were marshals and served as judges among other duties.
There was less due process with the colonial system, but there was something resembling it. Our system is based on that, stemming all the way back to the Magna Carta. I think I spelled that right.
That's really shitty when people can simply make a false accusation and have you locked up based on the lie.
In theory, there should be probable cause and a cause hearing established when being arraigned. One should be read their charges and the court should already have established that there's a reasonable chance that you did it.
The justice system doesn't always work and it's sure as fuck not equal. It could be worse, you could be a minority. Even when innocent, they're treated far worse.
And, equal? Ha! Yeah... Right... You and I are not gonna get the same treatment in court. Not even close.
No, the court views me as criminal by default, and you are viewed as an upstanding pillar of the community
