Specific licensed professions have highly specific exemptions, with proper data management procedures. Parents can have nanny cams, with age restrictions
As you can see, this quickly becomes a legal mess, and this is the whole purpose of trial by jury, and can easily lead to mob justice as well.
An easy answer would be decriminalizing possession and transfer, but you don't want to encourage the behavior either. I'd say woodchipper for those who actively harm, and data centers have zero liability for encrypted data.
