Thats a good point.
You do realize that policy would mean almost no music and no linking to archive sites or images that are made of news articles, right? In the US, pretty much everything is copyrighted on inception, since 1978(ish). Screenshots of news articles violate it. Archive sites violate it - with the exception of one that's sanctioned by the Library of Congress, and that's the archive.org site.
You should be okay as you're not hosting anything, but if you do enforce the policy you may lose your safe harbor protection and you may become liable.
The choice is for you to make.
I did not realize that at all. I almost feel like I need you as a mentor you are one wise sob. Only thing I am firm on at the moment is I will respond to any DMCA takes downs I receive.
As this site isn't hosting anything, you're unlikely to get any. But, in the event you do - just take 'em down.
The other guy made some strange comment about copyrighted material having nothing to do with speech. Their comment, the very comment they made, is copyrighted.
Yes, that's how copyright works. On inception it is invoked, creating certain rights that may be used to protect their work. You don't need to register it (unless you wish to reserve the right to sue for more than statutory damages) and it's created automatically.
If I go to Voat and copy one of your comments and come here and paste it, I'm violating copyright laws. Now, nobody gives a crap - but that's how the law works. Your work, your comment, is copyright protected on inception. (Your publication on their platform may cede some rights to them, but that is a whole other bowl of wax.)
As your entirely unofficial not-a-lawyer, just put a blurb in the TOS that says something like, "In the interest of reducing complexity and risk of financial harm, all DMCA notices will be complied with immediately."
Don't even get me started on all the images people upload and share! LOL The person you responded to was also in another thread complaining about my submission to a TED talk. I'm gonna guess they just don't like me. I'm okay with that. ;-)
