If the court granted their request, wouldn't ThedaCare be "disrupting access to critical care for the people" in Ascension Wisconsin's region by withholding critical staffing hires?

Yes, but the legal system doesn't work that way. The status quo is very heavily favored. Possession really is 9/10ths of the law. This is unfortunate because it gives a big advantage to the aggressor. Keeping momentum on your side is very important to winning cases.
