felony charges of Possession of Dangerous Drugs, Possession of Drug Paraphernalia and Resisting Arrest

Uh...

They only filed charges on resisting. This is called cops not wanting to admit they are wrong and/or get rid of someone. If cops have to show up somewhere they will usually make an arrest out of principle. They DNGAF if they can make charges stick. It puts someone away for a night or 3 days so they are sure they don't have to see them again.

Paywall. Gay.

It wasn’t behind a paywall earlier. Sorry, man.

Basically, the arrested guy got reported for a small amount of drugs and someone said he was wielding a knife but then the police said he didn’t have a knife, however, they said they found one nearby. Then the article mentioned that the guy was being charged with resisting arrest, and that he was not being prosecuted for the other laws he allegedly broke, which was the reason the police were called in the first place, but that he WAS being charged with resisting arrest but not charged with anything else. Crazy? I know.

AZ is a constitutional carry state (including knives) as long as you aren't a prohibited person (felon). He could've been concealing a claymore and it's not illegal.

You’re not wrong.. However, there was no mention of any medieval Scottish swords or anti-personnel mines in the article. Glad to know these things are not going to get me resisting arrested, lol.

I can't see those charges holding up without another criminal charge worthy of arrest.

You need reasonable suspicion that a crime was committed to make a lawful arrest.

Without some other worthy charge, it would seem he had a right to resist and that the officer is guilty of a civil rights violation.

But alas.. on clown world, things like truth, justice, logic, and reasoning don't necessarily apply.

I happened upon this short article and, believe it or not, it’s from NPR but is a reasonable explanation, even if it is not all encompassing. The guy failed to mention that a person’s Constitutional rights might be violated in the case of resisting arrest with no other charges.

so if theres no charges, and you say 'fuck you, you cant arrest me' and they arrest you on resisting arrest its kidnapping. resisting arrest makes no sense if that's the only charge. how am i resisting if im not being arrested. you have to be actively commiting a crime to be arrested which should be there anyway otherwise the charge is bullshit

They’ll say the guy was obstructing the police while they were investigating a crime, but that’s often a load of bullshit. Although this is a little off topic...I’ve seen cops yelling, “Stop resisting arrest!”, when the person they were arresting was in no way resisting. If it was me, I’d look into cases where the 5th and 14th Amendments were violated.

If more victims would just file permanent restraining orders on these cops to prevent retribution while you pursue their police certifications..

If you get arrested for resisting arrest, then you're not too good at it and needs moar practice resisting!
