so if theres no charges, and you say 'fuck you, you cant arrest me' and they arrest you on resisting arrest its kidnapping. resisting arrest makes no sense if that's the only charge. how am i resisting if im not being arrested. you have to be actively commiting a crime to be arrested which should be there anyway otherwise the charge is bullshit

They’ll say the guy was obstructing the police while they were investigating a crime, but that’s often a load of bullshit. Although this is a little off topic...I’ve seen cops yelling, “Stop resisting arrest!”, when the person they were arresting was in no way resisting. If it was me, I’d look into cases where the 5th and 14th Amendments were violated.
