I can enter a contract with you that says "if you say 'boo' you owe me $10." That's not an illegal contract if all parties consented to the terms. And if you refuse to pay I can use the courts to make you pay.

Private companies and individuals are free to enter contracts as long as the terms aren't specifically prohibited by law. Once entered, the contract terms are enforceable through the courts. What specific statute or precedent makes this illegal?

How about the precedent that permits misandrist judges to render legally crafted prenups null and void, for pretty much any reason their bitch brains can think up? Could it possibly be 'all contracts are equal, but some contracts are more equal than others'?

Each state is different. In some states you can't avoid liability to a former spouse by prenup.

On top of this, even if it is illegal, how easy does anyone think it would be to fight in court? These companies have whole departments of lawyers to fight while the common man would barely have time or money to even defend himself in court.

How is someone without an account going to get fined so they can sue PayPal? When you continue to use the service after being notified of the change you are agreeing to the new contract.
