In almost every state, participating in an illegal activity that results in death makes you responsible for the death. Even getaway drivers get charged with murder if the guys who went into the jewelry store killed someone.
Dude was a drug dealer and fired on police. I don’t care if he heard them announce or not (though I don’t believe at all that he didn’t), he either thought it was the police or he thought he was getting robbed for the drugs in his house.

Well they got him on the easier charge. It's good enough. No sense in wasting endless resources to try and achieve an exceptionally high bar. It's more efficient this way.
