I assume the driver sets the cruise control speed rather than the car deciding for itself, so he probably set it to go 5 over. Speeding a little is common practice, that's probably just how he always drives.

As to why the car was aimed at a barrier, didn't correct itself, didn't brake, and wasn't corrected or stopped by the driver, that's the big question. I recall that in the Arizona crash, some setting that allowed the car to stop itself had been disabled by Uber for some reason. Maybe that was also the case here?
