ATF is foundationally operating illegally.
Guns are Constitutionally protected and so the ATF has always been a criminal organization along with all their employees.
If they can operate outside the law, I see no reason why everyone shouldn't as long as they can back their people up with force like the ATF and FBI do.

And if theres a disparity of firepower between a standing army on u.s. soil, and average citizen armament, then technically "guns are constitutionally protected" barely even applies.

Well the founding fathers did. Also they thought about commissioning a puckle gun but another warship cost just as much.
