So I can send my slate of electors to Pence and he has to open them, eh?
Now go study the requirements for a lawful election and the lawful submission of electors to the President of the Senate. Go to a judge in any court in the land and submit your complaint on coloring paper written in crayon; see how far it gets you.
How about you read 3 USC ch. 1 sec. 15 and find that Slates of Electors must be from legal authorities claiming to have the appointment power therefore you sending in a slate would be nothing but funny. I wrote a book on the subject "The Electoral College for patriots" which required research into the Constitution, the laws implementing the Constitution, supreme Court rulings throughout its history, the federalist and anti-federalist papers and Elector cases from 2016. Notice I quote the Constitution and laws in pursuance thereof and you make up bullshit about crayons and coloring. I gave you the sources, you replied with make believe. Which of us should be relied on by other readers? Nice try better luck next time cupcake. I want Trump to win but I call bullshit when I see it and what is being spread is Bullshit about Pence's alleged power. I am simply trying to prevent people from placing their hopes in something that does not actually exist. Bring some sauce next time you step up to the buffet. Thank you.
Article II Section 1 The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years, and, together with the Vice President, chosen for the same Term, be elected, as follows
Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress
Who directed mail in ballots? Why did they have to issue executive orders? lol Pence has LEGAL DUTY to enforce the Constitution.
Now your saucin it cool tyvm. Michigan's legislature thru state laws directed that Electors shall be appointed by the popular vote of the state after the vote is certified by the secretary of state. So the manner was followed. The Michigan legislature did not fight for their turf by preventing the SoS from mailing out ballot apps. That's our problem in Michigan to deal with. The legislature allowed a dirty vote. The legislature did not send in a 2nd slate as they could and should have. I think Republican Electors may have sent them in but not by the authority of the legislature therefore they won't be recognized.
My main point is according to the US law 3 USC ch. 1 sec. 15 Congress must decide which Slates from States that legitimately sent in 2 slates are counted it is not up to the President of the Senate to decide which are the ones that will be counted. He opens all of them then if objections are raised the votes from both Houses of Congress decide. If the results of those votes give a person 270 they win. If their decision results in 269 or less for each then the House votes by State delegation (1 vote per State) to decide the winner. Funny thing Michigan's delegation is 7 Republican 7 Democrat in the House. Michigan would not vote for President unless someone crosses the aisle.
Again my point is that it is not up to Pence is all I am saying. We will find out which one of us is correct when it happens. If objections are not raised or both houses do not agree to the 2nd slates then the votes from the Electors whose names are on the 3 USC ch. 1 sec. 6 list sent in on Dec. 8th "shall be counted".
Actually I hope and Pray that I am wrong but having written a book based on the research and having read the material more times than I can remember I truly and sadly believe I am correct. Time to go to work so I won't be replying again anytime soon. Hope you have a great day! Were on the same side just with a difference of opinion. Peace.
You know, some times you can OVERTHINK things and you are living proof of it. I submit two simple questions -
1) If all the criminals agree that no crime was committed, does that mean that no crime was committed?
2) If a state certifies an election in which more votes were received than there are registered voters in that state, was the election held in a manner as directed by the state legislature?
1- no a crime was committed but the jury (Congress) allowed it to be gotten away with.
2-No but if the Legislature doesn't raise a finger to correct it it stands by reason of no contest.
